Washoe County Commissioners Bob Larkin, Bonnie Weber, Jim Galloway, David Humke, and Kitty Jung deliver an un-American form of government that violates the most basic tenets of democracy and administrative competence. Decent government under law is replaced by government under arrogant whim, intentional deception, and sheer incompetence in Washoe County!
The Nevada Open Meeting Law Manual clearly states the following:
... the legislature finds and declares that all public bodies exist to aid in the conduct of the people's business.
The people of this state do not yield their sovereignty to the agencies which serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for them to know and what is not good for them to know. The people insist on remaining informed so that they may retain control over instruments they have created.Consistent with the above quotations, U.S. v Holzer, states:
Fraud in its elementary common law sense of deceit… includes the deliberate concealment of material information in a setting of fiduciary obligation. A public official is a fiduciary toward the public … and if he deliberately conceals material information from them he is guilty of fraud.
In defiance of the foregoing, Larkin, Weber, Galloway, Humke, and Jung adamantly refuse to answer questions about the people's business. They work against the people being kept informed "so they may retain control over (their public servants)." Named commissioners feel free to thumb their noses at the citizens they're supposed to serve. Democracy can not function without a well-informed electorate ~ and Washoe's commissioners are committed to keeping Washoe citizens uninformed!
Refusing to answer questions amounts to treating the people's business as none of the people's business. This violates the sovereignty of the people and is nothing less than a form of treason.
Following are "random" questions which Larkin, Weber, Galloway, Humke, and Jung refuse to answer:
Why do you enforce some laws and regulations while ignoring others including the Constitution of the United States?
Why do you treat Nevada laws and even attorney general opinions as trumping free speech?
Why do you ignore the fact that AG opinions do not have weight of law?
Why are you afraid of citizens exercising free speech ~ as guaranteed by the Constitution?
Why do you state on each meeting agenda that you intend your proceedings should demonstrate the highest levels of decorum when your actions regularly violate the foundations of democratic decorum ~ including the supreme law of the land? You limit public comments to a ridiculous two minutes when the state standard is three minutes and Carson supervisors have NO limit. You refuse to answer questions asked of you by your employers. You refuse to agendize topics of concern to your employers. You practice censorship. You lie. You never consider the will of the people when making decisions. You abuse sheriff officers as Gestapo political police to enforce your tyranny and violations of law. You permit ~ or cause ~ technical problems with the cablecasting of meetings so that TV viewers will be denied full knowledge of what is said during those meetings. Obviously, you believe that "decorum" permits you to defecate on the people you're supposed to serve!
Why do you refuse to explain how you and D.A. Gammick lost the Ballardini lawsuit? Is it not a fact that paying for this loss will cost Washoe taxpayers at least $30-million? This is a pretty stiff price to pay for your incompetence.
Is it not a serious crime (fraud) for you commissioners and Gammick to conspire together to prevent clear and complete public knowledge of Ballardini lawsuit details? Is it not a clear violation of U.S. v. Holzer for you to withhold such knowledge from the public?
Would the budget crunch be less severe for Washoe citizens if you had not lost the Ballardini lawsuit? How many good things could be done with the $30-million you lost?
Why do you refuse to acknowledge that Washoe County's voting machines can be rigged to throw elections? Why are you not calling for decertification of these machines in keeping with what California has done? Why are you not moving to sue the voting machine company for fraud, i.e., misrepresenting their machines as being tamper-proof when they are nothing of the kind?
When did you decide to adopt meeting agendas in secret ~ in violation of the open meeting law? An agenda doesn't just happen. Its content has to be discussed and decided and you're now doing this away from public monitoring and input. How can any agenda represent the people's business when no public comment is permitted during its adoption process?Why do you insist on treating the people's business as none of their business?
Why do you ignore and violate your fiduciary obligations toward the people of Washoe?
Can you prove that you were honestly elected? When riggable voting machines are used to count votes, are "results" legitimate?
